The California Lemon Law, also known as the Song-Beverly Consumer Warranty Act, was created to protect consumers from purchasing or leasing a new or used car that turns out to be defective. The law provides a legal remedy for car buyers who have repeatedly attempted to repair their vehicles but to no avail.

Under the California Lemon Law, a “lemon” is defined as a new or used vehicle with a substantial defect that affects the use, value, or safety of the car and cannot be repaired after a reasonable number of attempts. The law applies to new and used vehicles purchased or leased in California, regardless of the make or model.

If a vehicle qualifies as a “lemon” under the California Lemon Law, the manufacturer must either replace the car or provide a full refund to the consumer. The manufacturer is also responsible for covering all reasonable costs, such as towing fees and rental car expenses incurred by the consumer.

The California Lemon Law also provides protection for consumers who leased their vehicles. If a leased vehicle is determined to be a lemon, the lessor must either replace the vehicle or provide a full refund of all amounts paid under the lease agreement.

It’s important to note that the California Lemon Law only applies if the manufacturer has been given a reasonable opportunity to repair the vehicle but has been unable to do so. Consumers must provide written documentation of the problems and repairs made to the vehicle, as well as the dates and odometer readings of when the vehicle was in for repair.
