Lemon Law for Motorcycles

When most people think about the terms “lemon law”, they think that it only refers to cars. However, lemon law also protects consumers who had purchased a motorcycle. Motorcycles are considered “consumer goods”, and thus, the California Lemon Law specifically protects these products (including motorcycles) in case they experience various issues that cannot be repaired within a reasonable number of attempts.

For California Lemon Law to apply to motorcycles, the motorcycle must have undergone repairs under warranty. Thus, a substantial number of motorcycles that go through the lemon law process are those that were purchased new with a manufacturer’s warranty. Nonetheless, motorcycles purchased “certified pre-owned” also generally qualify for California Lemon Law.
 
The general rule is that in order to qualify for California Lemon Law, the manufacturer must have had a “reasonable” amount of repair attempts to the vehicle. Nonetheless, what is “reasonable” entirely depends on how serious the defect is and the individual circumstances. Generally, the issue must impair in a substantial manner the value, use, and/or safety of the motorcycle. The law presumes that the manufacturer had a reasonable number of repair attempts if:
 
  • The same problem resulted in a “safety issue” that could cause serious injury or death if the motorcycle is driven, and an attempt was made to repair the motorcycle at least two or more times by the manufacturer or its dealerships (since motorcycles are inherently dangerous, issues that motorcycles experience are more often than not issues that can affect the safety of the rider); Or
  • An attempt was made at least 4 or more times by the manufacturer to repair a non safety-related issue; or
  • The motorcycle was not in service because of the repair attempt by the manufacturer or its agents for a total of more than 30 days cumulative,since the vehicle was purchased or leased.
